This End User License Agreement (“EULA”) is a legal agreement between you (“Licensee” or “you”) and hypernuclear (“Licensor” or “we”) for the use of hypershot (“the Software”). By installing or using the Software, you agree to be bound by the terms of this EULA.

Subject to your compliance with the terms of this EULA, hypernuclear grants you a non-exclusive, non-transferable, revocable license to install and use hypershot on up to three (3) personal devices across any platform (macOS, Windows, or other supported systems), for personal or commercial use.

  • Trial License — A free 7-day license with full feature access. Expires automatically after 7 days.
  • v1.x License — A perpetual license entitling you to all updates within the 1.x version range.
  • Lifetime License — A perpetual license entitling you to all future updates across all major versions.

Upon purchase, you will receive a license key. You are responsible for:

  • Keeping your license key confidential
  • Not sharing, publishing, or distributing your license key
  • Notifying us immediately if your license key is compromised

We reserve the right to revoke license keys that are shared, abused, or used in violation of this EULA.

You may not:

  1. Copy, modify, or distribute the Software except as expressly permitted by this EULA
  2. Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software
  3. Remove, alter, or obscure any proprietary notices on the Software
  4. Use the Software in any manner that violates applicable laws or regulations
  5. Rent, lease, lend, sell, sublicense, or distribute the Software or your license key
  6. Use the Software on more than three devices simultaneously (we soft-enforce this limit and reserve the right to revoke licenses that significantly exceed it)
  7. Use the Software to create a competing product or service

The Software, including all intellectual property rights therein, is and remains the exclusive property of hypernuclear. This EULA grants you a license to use the Software — it does not transfer ownership.

The hypershot name, logo, and any product names, logos, or trademarks associated with the Software are trademarks of hypernuclear and may not be used without prior written permission.

hypershot includes or is built upon certain open-source software components, including:

  • Qt Framework — Licensed under the GNU Lesser General Public License (LGPL) v3. Source code for Qt and any modifications is available upon request. See: https://www.qt.io/licensing

A complete list of third-party open-source components and their licenses is available in the application’s About panel. Each component is used in accordance with its respective license terms.

hypernuclear may provide updates, patches, or new versions of the Software from time to time. The updates you are entitled to depend on your license type. You are not obligated to install any update, but we recommend keeping the Software up to date for security and performance reasons.

Updates may modify, add, or remove certain features or functionality of the Software. You agree that hypernuclear has no obligation to (i) provide any specific updates, or (ii) continue to provide or enable any particular features or functionality of the Software.

7. Modifications and Discontinuation of the Software

hypernuclear reserves the right to modify, suspend, or discontinue the Software, temporarily or permanently, with or without notice. We shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Software.

The Software may display, include, or make available third-party content, or interact with third-party services such as cloud storage, analytics, or transcription providers (“Third-Party Services”).

You acknowledge and agree that hypernuclear shall not be responsible for any Third-Party Services, including their accuracy, completeness, timeliness, validity, legality, decency, quality, or any other aspect thereof. hypernuclear does not assume and shall not have any liability or responsibility to you or any other person or entity for any Third-Party Services.

Third-Party Services are provided solely as a convenience to you, and you access and use them entirely at your own risk and subject to such third parties’ terms and conditions.

Any feedback, comments, ideas, improvements, bug reports, or suggestions (collectively, “Suggestions”) you provide to hypernuclear regarding the Software shall remain the sole and exclusive property of hypernuclear.

hypernuclear shall be free to use, copy, modify, publish, or redistribute any Suggestions for any purpose and in any way, without any obligation to provide credit or compensation to you.

hypershot may offer optional anonymous analytics collection as described in the Privacy Policy. By enabling analytics, you consent to the collection and processing of anonymized usage data as described therein. You may withdraw this consent at any time via Settings → Privacy → Analytics without affecting your license or access to the Software.

We provide best-effort technical support via email at [email protected]. Support is not guaranteed and may be limited or unavailable at our discretion.

All paid licenses include a 30-day money-back guarantee from the date of purchase. If you are not satisfied with hypershot for any reason, contact us at [email protected] for a full refund. No questions asked.

This EULA does not exclude, limit, or override any consumer rights granted to you under applicable mandatory consumer protection laws. If you are a consumer (a natural person acting for purposes outside your business, trade, or profession), any provisions of this EULA that are less favorable to you than the rights granted under such laws shall be invalid, and the respective statutory provisions shall apply instead.

For consumers in the European Union: You may have the right to withdraw from this agreement within 14 days of purchase under EU remote sales law, except where you have downloaded and begun using the Software and have acknowledged that you thereby lose that right. Dispute resolution information for EU consumers is available at: https://ec.europa.eu/consumers/odr/

THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • THE SOFTWARE WILL MEET YOUR REQUIREMENTS
  • THE SOFTWARE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
  • THE RESULTS OBTAINED FROM THE SOFTWARE WILL BE ACCURATE OR RELIABLE
  • THE SOFTWARE WILL BE COMPATIBLE OR WORK WITH ANY OTHER SOFTWARE, APPLICATIONS, SYSTEMS, OR SERVICES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HYPERNUCLEAR OR ITS SUPPLIERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE LICENSE FEE PAID BY YOU FOR THE SOFTWARE.

You agree to indemnify, defend, and hold harmless hypernuclear and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Software, your violation of this EULA or applicable law, or your violation of any right of a third party.

This EULA is effective until terminated. It will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must:

  • Cease all use of the Software
  • Delete all copies of the Software from your devices
  • Destroy any license keys in your possession

Sections 4, 9, 12, 14, 15, and 17 shall survive termination.

hypernuclear may amend this EULA from time to time due to legal or technical reasons, including changes in applicable law or material changes to the Software.

You will be notified of any material amendments upon downloading a new version of the Software or via other reasonable notice. If you do not agree to the amended terms, you may terminate this EULA by ceasing use of the Software and deleting it from your devices. Continued use of the Software after the effective date of any amended EULA constitutes your acceptance of the new terms.

This EULA shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law principles. Any disputes arising under this EULA shall be resolved in the courts of California.

If any provision of this EULA is held to be invalid or unenforceable, such provision shall be changed and interpreted to accomplish its objectives to the greatest extent possible under applicable law, and the remaining provisions shall remain in full force and effect.

Except as provided herein, the failure of either party to exercise a right or to require performance of an obligation under this EULA shall not affect that party’s ability to exercise such right or require such performance at any time thereafter, nor shall the waiver of a breach constitute a waiver of any subsequent breach.

This EULA, together with the Terms of Service and Privacy Policy, constitutes the entire agreement between you and hypernuclear regarding the use of the Software, and supersedes all prior and contemporaneous written or oral agreements between you and hypernuclear.
