Thank you for using hypershot! These Terms of Service (“Terms”) govern your access to and use of hypershot, a screenshot, screen recording, and annotation application developed by hypernuclear (“we,” “us,” or “our”). By using hypershot, you agree to these Terms.
1. Acceptance of Terms
Section titled “1. Acceptance of Terms”By downloading, installing, or using hypershot, you agree to be bound by these Terms, our Privacy Policy, and our End User License Agreement (EULA). If you do not agree to all of these terms, do not use hypershot.
2. Description of Service
Section titled “2. Description of Service”hypershot is a desktop application that provides:
- Screenshot capture (area, window, and full screen)
- Screen recording with auto-zoom and cursor tracking
- Annotation tools (arrows, shapes, text, highlights, redaction, and more)
- Background and frame effects for exports
- OCR-powered text recognition
- Webcam overlay during recording
hypershot is available for macOS and Windows.
3. Accounts and Licenses
Section titled “3. Accounts and Licenses”3.1 Free Trial
Section titled “3.1 Free Trial”hypershot offers a 7-day free trial with full access to all features. No credit card is required to start the trial. The trial begins when you first launch the application.
3.2 Licenses
Section titled “3.2 Licenses”We offer the following license types:
- v1.x License — Entitles you to all updates within the 1.x version range.
- Lifetime License — Entitles you to all future updates, across all major versions.

3.3 License Restrictions
Section titled “3.3 License Restrictions”Each license is for one individual on up to two personal devices. You may not:
- Share, resell, or redistribute your license key
- Use a single license across a team or organization (contact us for team pricing)
- Reverse engineer, decompile, or disassemble the application
4. User Content
Section titled “4. User Content”You retain full ownership of all screenshots, recordings, and annotations you create with hypershot (“Your Content”). We do not access, store, or transmit Your Content. All processing happens locally on your device.
5. Acceptable Use
Section titled “5. Acceptable Use”You agree not to use hypershot to:
- Capture or record content you do not have the right to capture
- Violate any applicable laws or regulations
- Infringe on the privacy or intellectual property rights of others
- Create misleading or fraudulent content
6. Analytics
Section titled “6. Analytics”hypershot may collect anonymous usage data to help us improve the product. This may include:
- Feature usage counts (e.g., number of screenshots, tools used)
- Application performance data (e.g., load times, render performance)
- Crash reports and error logs
- Device information (OS version, hardware model)
What we do NOT collect:
- ❌ Screenshots, recordings, or annotations
- ❌ File names, paths, or contents
- ❌ Personal information or identity data
- ❌ Anything visible on your screen
Analytics data is aggregated and anonymized — it cannot be traced back to you individually.
You may opt in or out of analytics collection at any time via Settings → Privacy → Analytics. Your choice does not affect your access to any features of the application.
Analytics data may be processed by third-party services (such as crash reporting tools). These services are bound by their own privacy policies and data processing agreements.
7. Third-Party Software
Section titled “7. Third-Party Software”hypershot is built using the Qt framework, licensed under the GNU Lesser General Public License (LGPL) version 3. The Qt libraries are used in compliance with the LGPL v3 license terms. For details, see: https://www.qt.io/licensing

8. Updates
Section titled “8. Updates”We may release updates, patches, or new versions of hypershot from time to time. Your license type determines which updates you are entitled to receive. We are not obligated to provide any specific updates.
9. Disclaimer of Warranties
Section titled “9. Disclaimer of Warranties”hypershot is provided “as is” and “as available,” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that hypershot will be error-free, uninterrupted, or meet your specific requirements.
10. Limitation of Liability
Section titled “10. Limitation of Liability”To the maximum extent permitted by applicable law, hypernuclear shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, business interruption, or loss of profits, arising out of or in connection with your use of hypershot.
In no event shall our total liability exceed the amount you paid for your hypershot license.
11. Termination
Section titled “11. Termination”We may suspend or terminate your access to hypershot if you violate these Terms. Upon termination, you must uninstall the application and cease all use. Sections 4, 8, 9, and 11 shall survive termination.
12. Governing Law
Section titled “12. Governing Law”These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law principles.
13. Changes to These Terms
Section titled “13. Changes to These Terms”We may update these Terms from time to time. We will notify you of material changes via the application or by email. Your continued use of hypershot after changes are posted constitutes acceptance of the updated Terms.
14. Website Use
Section titled “14. Website Use”These Terms also apply to your use of the hypershot website at hypernuclear.com (“Website”). By accessing or using the Website, you agree to these Terms.
14.1 Website Content
Section titled “14.1 Website Content”The Website and its content are provided for informational purposes. You may not:
- Scrape, crawl, or otherwise extract data from the Website
- Reproduce, distribute, or modify Website content without written permission
- Use the Website in any manner that could damage, disable, or impair our servers or networks
14.2 Payment Processing
Section titled “14.2 Payment Processing”Purchases made through the Website are processed by our third-party payment provider. By making a purchase, you agree to:
- Provide accurate and complete billing information
- Pay all applicable charges at the listed prices, plus any taxes
- Your payment information being processed by our payment provider in accordance with their terms and privacy policy
We do not store your full credit card information on our servers. Refunds are processed in accordance with our 30-day money-back guarantee.

Section titled “14.3 Cookies and Website Analytics”The Website may use cookies and similar technologies to improve your browsing experience and collect anonymous usage data. You can manage cookie preferences through your browser settings.
